Notting Hill Cleaner Service Terms and Conditions

These Terms and Conditions set out the basis on which Notting Hill Cleaner provides professional cleaning services to residential and commercial clients. By booking or using any service, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.

Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Client means the individual or organisation making a booking or using the services.

Company means Notting Hill Cleaner providing the cleaning services.

Services means any cleaning or related work supplied by the Company to the Client, whether one-off, regular, end of tenancy, deep cleaning, office cleaning, or any other agreed service.

Premises means the property or location at which the Services are to be carried out.

Booking means the reservation of Services by the Client, whether made online, in writing, or verbally.

Scope of Services

The Company provides professional cleaning services within its service area, which includes Notting Hill and surrounding neighbourhoods, subject to availability and operational constraints. The exact nature, frequency, and scope of the Services will be agreed at the time of booking and confirmed in a booking confirmation where applicable.

Unless expressly agreed otherwise, the Services are limited to general cleaning tasks such as dusting, vacuuming, mopping, cleaning bathrooms, cleaning kitchens, and related duties that can be safely carried out by the cleaning staff using reasonable care and skill.

The Company reserves the right to decline tasks that are hazardous, illegal, unsafe, or outside the usual scope of domestic or commercial cleaning, including but not limited to heavy lifting, work at unsafe heights, specialised restoration work, or any activity that may put the cleaner or others at risk.

Booking Process

Bookings may be made via the Companys designated booking channels. By placing a Booking, the Client confirms that they are legally capable of entering into a binding contract and that the information provided is accurate and complete.

The Client must provide the Company with all relevant details, including the Premises address, access information, type of service required, preferred dates and times, and any specific instructions or priorities. The Company will use reasonable efforts to accommodate preferred dates and times but does not guarantee availability.

A Booking is deemed accepted only when the Company confirms it, which may be done verbally or in writing. The Company may, at its discretion, request additional information, a deposit, or prepayment before confirming the Booking.

For ongoing or regular cleaning arrangements, the frequency, duration, and approximate schedule of visits will be agreed in advance. The Company reserves the right to adjust schedules, with reasonable notice, to reflect operational needs, public holidays, or other circumstances.

Access to the Premises

The Client is responsible for ensuring that the Company and its cleaners have safe and timely access to the Premises at the agreed time. This may include providing keys, access codes, or arranging for someone to be present.

If cleaners are unable to gain access due to incorrect details, locked doors, or other issues outside the Companys control, the visit may be treated as a late cancellation and may be subject to a cancellation fee as set out in these Terms and Conditions.

All keys or access devices held by the Company on behalf of the Client will be stored securely and used solely for the purpose of delivering the Services.

Client Obligations

The Client agrees to:

Provide a safe working environment at the Premises, including functioning lighting, running water, and reasonable heating where required.

Inform the Company of any health and safety risks, hazards, or sensitive areas at the Premises, including fragile items, valuable objects, and areas where cleaning should be limited or avoided.

Ensure that any equipment provided by the Client for use by the cleaner, such as vacuum cleaners or other appliances, is in good working order and safe to operate.

Comply with all applicable laws and regulations relating to the Premises and use of the Services.

Payments and Charges

The Company will inform the Client of the applicable rates and any minimum charges before or at the time of booking. Rates may be based on hourly charges, fixed fees, or service packages, depending on the type of Service requested.

Unless agreed otherwise, payment is due on or before the day the Services are provided. The Company may require a deposit, advance payment, or card details to secure a Booking, particularly for first-time clients, end of tenancy cleans, deep cleaning, and large or specialised jobs.

Where Services are provided on a regular basis, the Company may issue invoices on a per-visit, weekly, fortnightly, or monthly basis, as agreed. Payment terms will be indicated on the invoice, and the Client must pay all invoices within the specified time frame.

If payment is not received by the due date, the Company reserves the right to suspend Services, charge reasonable late payment fees or interest, and take reasonable steps to recover any outstanding amounts, including legal action where necessary.

All charges are quoted exclusive of any applicable taxes, which will be added at the prevailing rate where required by law.

Cancellations and Amendments

The Client may cancel or amend a Booking by giving the Company reasonable notice. Unless otherwise agreed, the minimum notice required to cancel or reschedule without charge is 24 hours before the scheduled start time for standard domestic visits, and 48 hours for larger, commercial, or end of tenancy bookings.

Where the Client fails to provide the required notice, the Company may charge a cancellation fee up to the full amount of the scheduled visit, to reflect the time reserved and costs incurred.

If cleaners attend the Premises and cannot gain access, or if the Client refuses entry without adequate notice, this may be treated as a late cancellation and charged accordingly.

The Company reserves the right to cancel or reschedule Services where necessary due to staff illness, severe weather, operational issues, safety concerns, or circumstances beyond its reasonable control. In such cases, the Company will use reasonable efforts to notify the Client and, where possible, offer an alternative appointment. The Company will not be liable for any consequential loss arising from such cancellations.

Service Quality and Complaints

The Company aims to deliver a professional and reliable cleaning service at all times. If the Client is dissatisfied with any aspect of the Services, they should inform the Company as soon as reasonably possible, giving clear details of the issue and, where relevant, photographs or supporting information.

Where a justified complaint is made within a reasonable period after the service, the Company may, at its discretion, offer to rectify the issue by providing a re-clean of the affected areas or by offering a partial refund or credit. Any such remedy will be proportionate to the shortcomings identified and subject to fair use.

The Client agrees to provide the Company with a fair opportunity to investigate and remedy any complaint. Claims made long after the service may be more difficult to verify and may be rejected if there is insufficient evidence.

Liability and Insurance

The Company will exercise reasonable care and skill in performing the Services. The Company holds insurance appropriate for the nature of its operations, subject to policy terms, conditions, and exclusions.

The Companys liability to the Client for any loss or damage arising out of or in connection with the provision of the Services shall, to the fullest extent permitted by law, be limited to the amount paid or payable by the Client for the specific visit or service during which the incident occurred.

The Company will not be liable for:

Any pre-existing damage, wear and tear, or deterioration to property, fixtures, fittings, or contents.

Damage arising from the use of faulty equipment provided by the Client, including vacuum cleaners or appliances.

Loss of cash, jewellery, or items of high value that have not been clearly identified and secured by the Client.

Any indirect or consequential loss, loss of profit, loss of business, or loss of opportunity.

Nothing in these Terms and Conditions shall exclude or limit liability for death or personal injury caused by negligence, fraud, or any other liability that cannot lawfully be excluded or limited.

Damage and Breakages

If damage or breakage occurs that the Client believes was caused by a cleaner during the provision of the Services, the Client must notify the Company as soon as reasonably possible, providing details of the item, the nature of the damage, and any supporting evidence.

The Company may request the opportunity to inspect the item and, where appropriate, may arrange for repair or replacement, or offer fair compensation, taking into account age, condition, and fair wear and tear.

The Company is not responsible for items that are inherently fragile, poorly secured, or in disrepair, such as loose shelves, unstable fittings, or items that cannot reasonably be cleaned without risk of damage.

Waste Management and Regulations

The Company will handle ordinary household and commercial cleaning waste in accordance with applicable waste management regulations. This includes bagging general waste and recyclables and placing them in designated bins or areas at the Premises, where agreed as part of the Services.

The Company does not provide specialist waste removal, disposal of hazardous materials, clinical waste, or bulky waste removal unless specifically agreed and compliant with relevant regulations. Hazardous substances include, but are not limited to, medical waste, chemicals, solvents, and sharp objects.

The Client is responsible for ensuring that any waste to be handled by the Company is safe, appropriately contained, and lawful to handle as part of normal cleaning activities. The Company reserves the right to refuse to handle any waste it reasonably considers unsafe, illegal, or beyond the scope of normal cleaning duties.

Health and Safety

The Company is committed to maintaining high standards of health and safety for both its staff and Clients. Cleaners are instructed to follow safe working practices and to use cleaning products and equipment responsibly.

The Client must not ask or require cleaners to undertake tasks that may compromise their safety or breach health and safety regulations, such as climbing on unsafe surfaces, using inappropriate equipment, or handling hazardous substances.

Where the Company considers that conditions at the Premises pose an unacceptable risk, it may suspend or terminate the Services until the issues are resolved. Any such decision will be made reasonably and with due regard to the safety of all parties.

Privacy and Confidentiality

The Company will collect and process personal information necessary to manage bookings, deliver Services, and administer the Client relationship. The Company will handle such information in line with data protection principles and use it only for legitimate business purposes.

The Company will treat information about the Client and the Premises as confidential and will not disclose it to third parties except as required to deliver the Services, to comply with legal obligations, or with the Clients consent.

Termination of Services

Either party may terminate ongoing or regular Services by providing reasonable notice, typically not less than 7 days for regular domestic cleaning and not less than 14 days for ongoing commercial arrangements, unless otherwise agreed in writing.

The Company may terminate or suspend Services with immediate effect where the Client fails to make due payments, breaches these Terms and Conditions, behaves abusively or unreasonably towards staff, creates unsafe conditions, or engages in unlawful activity in connection with the Services.

Amendments to Terms and Conditions

The Company may update or amend these Terms and Conditions from time to time to reflect changes in law, industry practice, or operational requirements. The most current version will apply to all new and ongoing Services after the effective date of the change.

Where changes materially affect existing Clients, the Company will provide reasonable notice, and continued use of the Services after such notice will be deemed acceptance of the updated Terms and Conditions.

Governing Law and Jurisdiction

These Terms and Conditions and any dispute or claim arising out of or in connection with them or their subject matter shall be governed by and construed in accordance with the laws of England and Wales.

The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the provision of the Services.

Severability

If any provision of these Terms and Conditions is held to be invalid, unlawful, or unenforceable by a court or competent authority, that provision shall be deemed severed from the remaining provisions, which shall continue to be valid and enforceable to the fullest extent permitted by law.

Entire Agreement

These Terms and Conditions constitute the entire agreement between the Company and the Client in relation to the provision of the Services and supersede any prior discussions, correspondence, or understandings, whether written or oral, relating to the subject matter.

No variation of these Terms and Conditions shall be effective unless agreed in writing by the Company.
